The rituals (such as pooja, prasad, abhishekam, etc.) are performed at the place requested by the user through representatives appointed by click4pandit.com before or after the payment of the required fee to us (wherever applicable). The charges mentioned include the cost of materials required for conducting the pooja, charges paid to our representative for performing the offering and other charges such as taxes, etc. Kindly note that we do NOT take any donations, chanda, chadhawa, etc. If you discover anyone misrepresenting us – please let us know at the earliest at contact@click4pandit.com.

• Product Liability Disclaimer

  Homams And Pujas
  The rate that is mentioned for all the homams and pujas are performed only for you privately or for anyone of your choosing which must be specified during the booking process. If you want us to perform our services on a group basis (group sankalpam), write to us at contact@click4pandit.com.
  
  Force Majeure
  Neither party will be liable for performance delays or for non-performance due to causes beyond its reasonable control. In the event of a threatened default or default as a result of any cause beyond its reasonable control, the defaulting party shall nonetheless exercise its best efforts to avoid and cure such default. In the event that performance of requested activity is prevented thereunder for a period in excess of seven (7) days, then the non-defaulting party may elect to terminate this Agreement and/or cancel or suspend any Orders thereunder by a written notice/intimation to the defaulting party. The party prevented from carrying out its obligations hereunder shall give notice to the other party of an event of Force Majeure upon it being foreseen by, or becoming known to, the defaulting party. Independent Contractor Also note that all the priests and related vendors registered with Click4Pandit.com performing pujas at your request are all independent contractors and therefore Click4Pandit.com shall not be answerable to any dispute or problem that arises in between the User and the priests and related vendors. Kindly Note that Click4Pandit.com is just a connecting platform for users to connect with priests and other vendors.



• Disclaimer of Warranty

  Click4Pandit.com makes no representations or warranties of any kind, express or implied, as to the operation of the site or the information, content, materials, or products included on this site including the fact that Click4Pandit.com is not the authorized agent or service provider appointed by any temple authority for which services are being provided herein. To the full extent permissible by applicable law, Click4Pandit.com disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Click4Pandit.com will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Kolkata, West Bengal, India in all disputes arising out of or relating to the use of the Click4Pandit.com site and its services. Use of the Click4Pandit.com site and its services are unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree to indemnify and hold Click4Pandit.com, franchisees, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys’ fees, asserted by any third party due to or arising out of your use of or conduct on the Click4Pandit.com site/services. Click4Pandit.com reserves the right to disclose any personal information about you or your use of the Click4Pandit.com site/services, including its contents, without your prior permission if Click4Pandit.com has a good faith belief that such action is necessary to:

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Click4Pandit.com with respect to the Click4Pandit.com site/services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Click4Pandit.com with respect to the Click4Pandit.com site/services.



• Dispute Resolution

  If a dispute arises between you and Click4Pandit.com, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. Accordingly, you and we hereby agree that we will resolve any claim or controversy at law and equity that arises out of the Terms of Use or the Website in accordance with this clause or as we and you otherwise agree in writing. Before resorting to the filing of a formal lawsuit, we strongly encourage you to first contact us directly to seek a resolution via e-mail at contact@click4pandit.com. The dispute shall be resolved through alternative dispute resolution procedures, such as mediation, failing which, through arbitration, as alternatives to litigation.
  Any dispute or difference arising between the parties in respect of or arising out of this Contract shall be settled by a Sole Arbitrator appointed by Click4Pandit. The Arbitration shall be conducted as per the provisions of the Arbitration and Conciliation Act, 1996. The venue of arbitration shall be Kolkata, West Bengal. The Courts at Kolkata shall have the exclusive jurisdiction to deal and decide any/all the matters arising under this Contract.



• Others

  The benefits of Homams, Pujas and other rituals, mentioned in our website, are as per the Shastras. The outcome of the rituals may vary from one individual to another and we at Click4Pandit.com do not promise any outcomes. You will be provided with the aforesaid services at your sole-discretion as and when you book the said services through Click4Pandit.com.

Important note: All Pujas and other rituals offered through our website are sathvik and are conducted in accordance with our Shastras.
